These Terms of Service SecureVPN (“Agreement”, “Terms”) set forth terms and conditions of your use of our virtual private network services namely SecureVPN, related services and features (“Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and INSPIRITUM LTD (“INSPIRITUM”, “we”, “us” or “our”). By accessing and using Services, you acknowledge that you have read, understood and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and INSPIRITUM, even though it is electronic and is not physically signed by you, and it governs your use of the Services. If you don't agree with any provisions of this Agreement, you shall not be able to access and use Services and you must destroy, return or delete all copies of Inspiritum LTD applications in your possession.

You hereby represent and warrant that you will access and use Services solely for privacy and security needs and in full compliance with all applicable local, state, national, and international laws, rules and regulations. It is NOT a service for the commission of criminal acts. You shall not agree to, nor shall you authorize or encourage any third party to: (i) access and use Services for any fraudulent or inappropriate or illegal purpose (as may be specified in this Agreement or by any applicable legislation); or (ii) act in any way that violates this Agreement.

Your use of services

You may access and use Services only in case you are legally capacitated and authorized to conclude an agreement with INSPIRITUM and such conclusion is not forbidden to you according to the applicable laws of your country.

To protect our Services from being misused, abused or being used to harm someone, here are the rules which apply to every User of Services. These rules have been erected solely to ensure that every Secure VPN user gets to enjoy complete internet freedom, without harassing or harming any other user, and without abusing our Service. We reserve the right to terminate your use of the Services for violating any of the prohibited uses or for any other reason in our sole and exclusive decision.

You specifically agree not to:

• Use our Services for any illegal use, such as transmitting any illegal material that would constitute a criminal offense as per the local, state, national or international law or regulation;

• Use our Services for the purpose of transmitting spam; to scan ports, open proxies, open relays; sending unsolicited emails in bulk quantities for opt-ins or for advertising/marketing purposes, even if the email is sent/received by another server;

• Use our Services to serve pop-ups ads;

• Use our Services for attacking in any way, shape or form any other computer or network;

• Use our Services to transmit any content that is unlawful, harmful, threatening, abusive, harassing, torturous, or that can be deemed objectionable in a court of law;

• Use our Services to harm, threaten, ‘stalk’ or otherwise harass another person/business;

• Use our Services to manipulate headers or forge identifiers in order to disguise the origin of any content transmitted through our Services;

• Use our Services to engage in any form of unsolicited or unauthorized advertising/marketing/promotional activities;

• Use our Services to get involved in the transmission of software viruses or malicious software aimed at harming other software/hardware/telecommunications equipment;

• Use our Services to disobey any policies/procedures/regulations of networks associated with our Services;

• Use our Services to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; to submit false or misleading information;

• Use our Services to knowingly or unknowingly violate any international, governmental, federal, provincial or state regulations, rules, laws, or local ordinances;

• Use our Services to promote illegal activities, or provide means for/helping other people commit illegal activities by providing instructional information;

• Use our Services for infringe upon or violating our intellectual property rights or the intellectual property rights of others;

• Use our Services to promote or incite physical harm or injury against any group or individual, or promote any act of cruelty to animals;

• Use our Services to conceal a true recipient email address in furtherance of the violation of the lawful terms of another service;

• Use our Services to solicit others to perform or participate in any unlawful acts;

• Use our Services to abuse our Service by scripting and using software to consume more resources than other users over a short period of time;

• Use our Services to report a message forwarded normally through the Service as spam to an organization in a way that implicates the Service as the source of the spam;

• Use our Services to create automated or manually excessive connections to get different IPs or for any reason. Excessive connections are a nuisance since they create a bottleneck and choke our network, the price of which is paid by other users, and that is completely unacceptable. Maximum allowed sessions are 300 per day and exceeding this limit may result in permanent suspension or termination of your use of our Services, unless explicitly allowed by us.

• Use our Services for forwarding email address, which requires that the Service communicate with a mail server that has “grey-listed” the mail server of the Services;

• Use our Services to access/share/upload/download illegal content including but not limited to, child pornography or content perceived to be child pornography. The use of Services by any such User found involved in this or any such activity will be suspended immediately without notice;

• Use our Services to mask IPs for generating searches on search engines, link building on forums, manual or automated crawling of websites and any other such activity that falls under the domain of search engine optimization, forum commenting, or data mining, unless specifically allowed by us;

• Use our Services to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service;

• Use our Services to collect or track the personal information of others;

• Use our Services to spam, phish, harm, pretext, spider, crawl, or scrape;

• Use our Services for any obscene or immoral purpose; and/or;

• Use our Services to interfere with or circumvent the security features of Services.

Actual service coverage, speeds, locations and quality may vary. The Service will attempt to be available at all times except for limited periods for maintenance and repair. However, the Service may be subject to unavailability for a variety of factors beyond our control including emergencies, third party service failures, transmission, equipment or network problems or limitations, interference, signal strength may be interrupted, refused, limited or curtailed.

We are not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service or communications services or networks (e.g., T-1 lines or the Internet). We may impose usage or Service limits, suspend Service, or block certain kinds of usage in our sole discretion to protect users or the Service. Network speed is an estimate and is no indication of the speed at which you or the Service sends or receives data. Actual network speed will vary based on configuration, compression, network congestion and other factors. The accuracy and timeliness of data received is not guaranteed; delays or omissions may occur.

Intellectual property rights

“Intellectual Property Rights” means all present and future rights conferred by statute, common law or equity in or in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world. This Agreement does not transfer to you any intellectual property owned by INSPIRITUM or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with INSPIRITUM. All trademarks, service marks, graphics and logos used in connection with the Services, are trademarks or registered trademarks of INSPIRITUM or its licensors. Other trademarks, service marks, graphics and logos used in connection with Services may be the trademarks of other third parties. Your use of Services grants you no right or license to reproduce or otherwise use any of INSPIRITUM or third-party trademarks.

INSPIRITUM grants you a limited, non-exclusive, non-transferable and non-assignable right and ability to use the software for such purposes as are ordinary and customary. You agree to not alter or modify the software. You are not authorized to combine the software with any other software program, create derivative works based upon the software, nor are You authorized to integrate any plug-in or enhancement which uses or relies upon the software. You further agree not to reverse engineer, decompile or otherwise attempt to uncover the source code. Except as expressly provided for in this section, this Agreement does not grant You any rights in the software and all rights are reserved by INSPIRITUM and/or third-party partners.

You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all content or data used by you in connection with Services. INSPIRITUM does not own or use any User data, information or material.

Disclaimers

You agree that Secure VPN is provided on an “as is” and “available basis” and that your use of Services is solely at your own risk. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Services will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error-free; nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of ay information obtained through the Service or that defects in the Service will be corrected. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of Service is done at your own discretion and risk and that you will be solely responsible for any damage or loss of data that results from the download of such material and/or data. We make no warranty regarding any goods or services purchased or obtained through the Service or any transactions entered into through the Service unless stated otherwise. No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly made herein.

It is your sole obligation to investigate whether you are allowed to use Secure VPN in your territory, as well as whether you are of legal age to use Services. Please note that you must refrain from use of our Services in case such use is not allowed by any applicable laws in your territory.

Limitation of liability

IN NO EVENT SHALL WE, OUR EMPLOYEES, SUBSIDIARIES, AGENTS, PARTNERS, THIRD-PARTY CONTENT PROVIDERS, VENDORS, AND/OR OUR OR THEIR RESPECTIVE DIRECTORS, OFFICERS, AND MEMBERS, BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, OR OTHER DAMAGES, INCLUDING BUT NOT LIMITED TO EXEMPLARY, RELIANCE, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, BUSINESS INTERRUPTION, REPUTATIONAL HARM, OR LOSS OF INFORMATION OR DATA, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SERVICES.

YOUR SOLE AND EXCLUSIVE RIGHT AND REMEDY IN CASE OF DISSATISFACTION WITH THE SERVICES OR ANY OTHER GRIEVANCE, SHALL BE YOUR DISCONTINUATION OF ACCESS TO OR UTILIZATION OF THE SERVICES.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO CERTAIN USERS.

You understand that INSPIRITUM cannot be held liable for any loss, corruption, alteration or removal of any content transmitted via our Services or through our Virtual Private Network. By agreeing to use our Services, you explicitly waive any rights to seek damages or hold INSPIRITUM liable for any such loss, alteration, corruption or removal. If and when required, we may temporarily/permanently revise or discontinue all or any part of our Services, which might impact the way you use our Services, with or without notice. You agree that you or any third-party will not hold us liable for any such revision, suspension or discontinuation.

General provisions

These Terms do not give any right to any Third Party except any provision in these Terms.

The Parties are independent contractors under these Terms, and nothing herein shall be construed to create a partnership, joint venture or agency relationship between them. Neither Party has authority to enter into Terms of any kind in the name of the other Party.

These Terms shall be governed and construed in accordance with the laws of Cyprus.

If any part of this Agreement is determined to be invalid or unenforceable by applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Agreement will continue in effect.

We may amend these Terms of Service from time to time. New version of these Terms shall be placed at https://secure-vpn.online/en/terms-of-use.html. It is your responsibility to check any updates of Terms from time to time. In case you continue use of Services after new version is placed at https://secure-vpn.online/en/terms-of-use.html, you deem to have agreed to be fully bound by provisions of such new version. In case of any disagreement with the updated Terms you must immediately stop using Services.
